On Monday, the Borough of Middletown filed a lawsuit to prevent the imposition of a substantial surcharge by Suez on our residents’ water and sewer bills. The Borough’s position is that this surcharge is not justified and is contrary to the terms of the lease deal negotiated in 2014. The Borough has a responsibility to make sure that the lease is being complied with and that our residents are provided with efficient and sound water and sewer service at rates not in excess of what is permitted by the lease. While the Mayor and Council would have preferred to avoid litigation, our efforts to mediate our disputes with Suez were unsuccessful and we were forced to pursue judicial remedies. The Borough will continue to take whatever steps are necessary to protect our residents and to make the Borough an attractive place to live and do business. Further updates will be provided as this case progresses.
